These Terms of Service ("Terms") govern your access to and use of Dwell Transit's rider and driver apps, websites, and transit data feeds (together, the "Services"). By using the Services, you agree to these Terms. If you do not agree, do not use the Services.
The Services
Dwell provides real-time transit information (including vehicle positions and estimated arrival times) for university campuses, on behalf of the universities and transit operators we work with. The features available may vary by campus and may change over time.
Estimates, not guarantees
Arrival times and vehicle positions shown in the Services are estimates generated from live and historical data. They can be delayed, incomplete, or inaccurate for reasons outside our control, including equipment, network, weather, traffic, and service changes. Do not rely on the Services where timing is safety-critical, and always use good judgment around vehicles and roadways.
Eligibility
You must be able to form a binding contract to use the Services, and you must use them in compliance with these Terms and all applicable laws. The Services are not directed to children under 13.
Accounts
Some features require an account. You are responsible for keeping your credentials confidential and for activity that occurs under your account. Notify us promptly of any unauthorized use. Driver and operator accounts may be administered by the university or transit operator you are associated with.
Acceptable use
You agree not to:
- Use the Services in any unlawful way or for any unlawful purpose.
- Interfere with or disrupt the integrity, security, or performance of the Services.
- Attempt to gain unauthorized access to any systems or accounts.
- Reverse engineer or misuse the Services except to the extent permitted by law.
Data feeds
We publish certain transit data feeds (for example, standards-based GTFS and GTFS-Realtime feeds). Your use of those feeds may be subject to additional terms and to the policies of the relevant university or transit operator. Feeds are provided on an "as available" basis and may change or be discontinued.
Intellectual property
The Services, including their software, content, and branding, are owned by Dwell or its licensors and are protected by law. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Services for their intended purpose. University names, logos, and colors used within campus experiences belong to their respective owners.
Third-party services
The Services may rely on or link to third-party services (such as map providers, app stores, and the data provided by universities and transit operators). We are not responsible for third-party services, and your use of them may be governed by their own terms.
Disclaimers
The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement, to the fullest extent permitted by law.
Limitation of liability
To the fullest extent permitted by law, Dwell will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your use of, or inability to use, the Services, including reliance on any estimate or information provided.
Indemnification
You agree to indemnify and hold harmless Dwell from claims and expenses arising out of your misuse of the Services or your violation of these Terms.
Changes and termination
We may modify the Services or these Terms at any time. When we change these Terms, we will update the "Last updated" date above. We may suspend or terminate access to the Services at our discretion, including for violation of these Terms.
Governing law
These Terms are governed by the laws of the State of [your state/jurisdiction], United States, without regard to its conflict-of-laws rules.
